Warranty

The Products to which this Limited Warranty Certificate is attached will be warranted by its manufacturer, Okamura Corporation, a corporation organized and existing under the laws of Japan (hereinafter called OKM) having its registered principal office at 7-18, Kita-Saiwai 2-chome, Nishi-ku, Yokohama, Japan, in accordance with the following;

The Products to which mentioned below shall, to such extend as herein set forth, be warranted to be free from defects in their design, materials and workmanship, affecting normal function. 

The Products covered by this Warranty are limited to the ones certified by international standards such as BIFMA or EN. (Kindly ask the sales representative if unsure about standard.)

This Warranty shall be valid only when OKM’s authorized local dealer certifies the date of ultimate sale at point of delivery to the end user. The warranty shall be effective, for the following respective periods from the date of handover to the dealer and is applicable only to Products originally manufactured by or for OKM after 1st of January 2022 as identified by the production lot number indicated on the production label. The warranty will expire at the end of respective warranty periods.

During the above applicable warranty periods, if OKM finds the Products to be defective to the extent as covered by this Warranty, OKM or its subsidiaries or its authorized retailer who have sold the applicable Products will, repair or replace or readjust the defective Products for free when the same are returned to OKM or OKM’s representative, but no monetary compensation will be made for any reason in connection with such defects of the Products. The Products or all parts of the Products that OKM have replaced become OKM’s property. If replacement with the same models is not possible, the Products may be replaced with other products of equal or better performance than the Products covered by this Warranty. The customer is responsible for delivery charges when returning the Products to OKM or OKM’s representative.

The said warranty shall not apply after the said warranty periods have expired, or when the Products have been at any time used in irregular or overloaded manner, or when the Products have ever been rented or leased, or when the Products have been repaired or modified by those other than OKM, OKM’s subsidiary companies or authorized repair service agents or when the Products become in need of repair or replacement due to any prior non-conforming repairs disregarding the manuals stated in the OKM official repair guides.

OKM’S WARRANTY IS EXCLUSIVELY AND ENTIRELY EXPRESSED IN THIS STATEMENT AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

OKM NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME ANY OTHER LIABILITIES ARISING OUT OF OR IN CONNECTION WITH THE SALE OR USE OF ANY PRODUCT. THE REMEDIES OF BUYER SET FORTH HEREIN SHALL BE THE ONLY REMEDIES AVAILABLE. IN NO EVENT SHALL OKM AND ITS SUBSIDIARIES BE LIABLE FOR SPECIAL, INCIDENTAL, COMPENSATORY OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, WHETHER A CLAIM FOR SUCH DAMAGES IS BASED UPON WARRANTY, CONTRACT, TORT, COMMON LAW, STATUTE OR OTHERWISE. 

Notwithstanding the terms of this certificate, this Warranty does not cover: 

• Damage reasonably expected as a result of normal wear and tear
• Natural variations, scars, marks or wrinkles occurring in the leather
• Colorfastness of textiles
• Color matching of textiles exactly to samples or swatches or past purchases
• COM (customer’s own material) or COL (customer’s own leather) upholstery materials selected by and used on OKM products at the request of the Buyer and any other fabric which is not considered standard to OKM
• Natural variations in wood grain or figure or the presence of character marks
• Colorfastness or the matching of colors of wood grain, including an exact match to samples or swatches or past purchases
• Non-standard products (customized sizes, materials, finishes)
• Products exposed to extreme environmental conditions or improper storage conditions
• Operating noises from adjustable/movable products such as reclining noises etc. (Some products may make noises during operation)
• Defects in products that have been disassembled or modified by the customer
• Defects in products that have been installed by persons other than our authorized dealers
• Failure or damage caused by moving or transporting the products after delivery
• Failure or damage caused by moving or transporting the products after installation by the customer
• Damage other than normal damage caused by product malfunction or defect
• Products have not been assembled in accordance with the instruction manual issued by OKM
• Products have not been used in accordance with the instruction manual issued by OKM
• The customer is found to be negligent in the way the products are used (by the manufacturer)
• The production lot number on the production label has been erased, deleted, or tampered with
